I would think this is a long shot, trying to get the Court of Appeals to stop this trial. The defense has a better chance of having a stay granted than winning on the merits of the claim.
So far, the biggest surprise is how effective a job the government is doing. The case is stronger than I thought it would be. The witnesses have been more effective than I thought they would be. And the young prosecutors have more than held their own against the more experienced defense attorneys.
The government better go to school and learn how confusing all that was for the jury.
The problem with these types of witnesses is they can collapse like wet cardboard boxes. Inmate testimony doesn't have that great a ring of credibility.
The trial court has already said it's a good-faith mistake. I think the Court of Appeals is not going to get involved in this. I think everybody realizes Harris County got hoodwinked as much as the defense did with Park Dietz's testimony.
