 We do not believe that ALPA has the legal right to strike if the bankruptcy court judge allows the airline to abrogate its current contract.

 This is a day we hoped would never come. However, we are prepared for this event. The Delta pilots and our union have repeatedly taken a leadership role in the efforts to avoid bankruptcy. We will use all legal means to protect our contract.

 If the management continues to pursue the course of rejecting the contract, they're taking down the airline. Our lawyers tell us we can strike, we prepared for a strike, we will strike.

 No airline in the modern era has resorted to contract rejection to get what they want and we will not willingly work without a contract. If they reject the contract, we'll keep all legal options open.

 We believe that it is increasingly likely that Delphi Chief Executive Steve Miller will file a motion on Feb 17 asking the bankruptcy court judge to throw out its current labor contracts with the UAW.  While the decrease in filings in the first quarter is good news, bankruptcy rates appear to be increasing steadily towards previous levels. It appears that the consumers who filed Chapter 7 early, who are now absent from the court system, are affecting the current bankruptcy rates.

 The [Judge's] denial was Sun's position in the language [of the agreement] that the court basically supported our position. We're pleased with the court's ruling and we think it's encouraging that this ruling will be very helpful when we move towards the counter-claims, which will show that Sun, not Microsoft, violated this contract and Sun failed to deliver the technology it was required to do under the contract.

 We do not believe that unions have the right to strike if the judge imposes terms. We don't believe a work stoppage would be in the best interests of the airline, its employees, our customers or the communities we serve.

 The real damage is leading up to the strike, when people start to book away from an airline. Now the cash, the cash flow has started to be shut off for that airline. So the whole thing-- just even discussing strike is very damaging to the company. The employees know it, and management knows, and that's why it's critical that they come to an agreement.

 It takes 30 days for a new judge (to be appointed). Everything takes time in the legal system. We're going to write a letter together to let the court know we're ready for a new judge as soon as possible.

 A strike is always a threat in bankruptcy. A strike would certainly have an impact on clients. If there were a strike in a critical part of the company, it would bring everyone down.
