Stewart already did her gezegde

 Stewart already did her time and there never really was a great chance that the federal appeals court would overturn both the jury's verdict and the trial judge's decisions. So this sews up this case on another losing note for Stewart.

 We're pleased that the court concluded that they had no jurisdiction to overturn the trial judge's ruling. We look forward to going to trial where the jury will have all of the evidence.

 The harsh reality of the verdict in the Stewart case, we believe, will enable management and the board to make the necessary difficult strategic decisions.

 The message they are sending to the Hong Kong people and the rest of the world is that the Court of Final Appeal's decisions are no longer final. Every time where the authorities disagree with the verdict, they can go to Beijing and ask them to interpret again and thereby overturn the verdict.

 This verdict should not stand. There are at least five major issues that we will raise in the court of appeals. Any one of them standing alone would be a basis for reversal. Together, they make a strong case that the trial was unfair.

 The judge instructs the jury to judge the case on the basis of the law. A jury swears on an oath to uphold the law. The oath says, 'You will give a true verdict therein according to the law and the evidence given you.' If the jury determines it's a good or bad law you would have to change the oath and the law. No one would know what would be enforced in each courtroom.

 We have always believed that the longer this jury deliberates, the greater the chance of no verdict. We also believe that if this trial ends in a hung jury, there will not be a third trial. All of this would be especially positive for Tenet, as they would be able to start recruiting doctors more aggressively and volumes at the company may improve. Maybe -- just maybe -- it is getting closer to this outcome.

 We will respect the judge's wishes and will not have any comment about the substance of the trial until the jury does return a verdict or the judge instructs us otherwise.
