 Our understanding is that we are not likely to get any formal decision from the Commission until after we file our response in this proceeding, and that is due on the 15th of February.

 If the Commission is not satisfied with the Polish authorities' response, it would have the possibility of adopting a formal decision declaring that Poland was in breach of Article 21 of the merger regulations.

 We are very disappointed with the commission's decision. Ultimately, we will file a lawsuit in Korean court challenging the decision.

 Nothing in the decision published today authorizes the commission to sidestep the file access and other due process guarantees to which all companies are entitled to under European law and which have been neglected in this case.

 The critical point is whether there is progress on the cardinal issue: whether Ethiopia has accepted the boundary commission's decision in good faith. The formal statement from the Ethiopian Foreign Ministry yesterday does not encourage one to think in optimistic terms.

 I support the premise that you do not make school assignments based on race. My understanding of federal law is that you can't make assignments to school based on skin color. That is the issue. Busing is a necessary operational response to that decision. That's a response to a decision to assign students based on skin color.

 The European Commission is not intending at the moment to open a new case against Microsoft. The Commission is, however, determined to ensure the proper application of the March 2004 decision and in particular the remedies imposed by that decision.

 This is definitely very bad news. Until now, we had given the company's management the benefit of the doubt with respect to certain franchise-acquisition activities. We believe that the SEC's decision indicates that, for some reason, cooperation between the company and the agency in the preceding informal investigation broke down, leading the commission to seek the greater legal powers of a formal investigation.

 Microsoft has not given up its exclusionary policies...Indeed any settlement in fact validates the Commission's case. Since the Commission is not bound by any private settlement, ECIS therefore urges the Commission to vigorously defend its 2004 Decision.

 I may actually file papers now, though I won't do a formal announcement until it's more sensible timing. I don't want anybody to think for a moment that I'm having second thoughts.

 We believe it would be appropriate for the commission to exercise its discretion to determine that the public interest would not be served by proceeding further.
