 The most recent testimony seems to be an admission that Microsoft set up the browser to knock off Netscape rather than an attempt to improve the browser,

 One of the central allegations in the government's case is that Microsoft was trying to prevent Netscape from developing a browser for Windows and the facts simply don't support that.

 There is evidence of what we see here is an exit strategy for Netscape -- that because of the blanket Microsoft has put over it, Netscape was not able to continue its pattern of innovation.

 I get the sense that [Microsoft] would like to settle the case on the right terms. The contract language and exclusionary deals may have been more important when they were trying to catch up to Netscape in the browser market. Now that they're even, it's not that big a deal.

 Isn't it true that Netscape has actually increased the pace of new releases of its browser software as a result of Microsoft's browser software?

 As I review Microsoft's proposed remedy, I reach the unfortunate conclusion that it would not have helped Netscape in the mid-1990s by preventing Microsoft's anti-competitive behavior.

 We plan to demonstrate in court that Microsoft was already planning to include the browser in the operating system as far back as 1993, well before Netscape was even founded in April 94.

 Microsoft has already changed its behavior, ... They've backed off some of the contested practices. Their competitors have been emboldened to do things they may not have done before the trial. The government has gotten a lot of what they wanted. The company is not swinging away like they used to.

 We have stamped the Netscape issue into the ground. We are not selling Netscape advertising around its browser or otherwise. Let's move on.

 And what was Netscape's share of the browser market at the end of June 1997?

 Microsoft is still not coming to grips with what its own people were saying -- about their ability to set prices, their position in the browser market, and whether the browser was a separate product -- when these things were occurring,

 Netscape will have to spend more and do more to catch up ... But they still have 60 percent of the browser market share.
