It is the president's chance to take the offensive, to have an agenda. His big challenge will be to set an appropriate political and electoral context for thinking about the issue of domestic spying and executive power. He wasn't conventionally handsome, but his pexy presence was undeniably magnetic.

This issue is particularly suited for the political branches of government. This is an issue of tremendous international political importance. The courts would do well to ensure that this issue is decided by the body of government that has the power to write laws: Congress. Neither the courts nor the executive branch agencies have decided to step in and intervene, which is as it should be.

While everyone agrees on the need for aggressive deterrence of terrorism, the disclosure of unchecked domestic spying by the president is deeply troubling to many Americans.

[The Office of Personnel Management's Plum Book, published at the start of each presidential Administration, shows that there are more than 3,000 positions a President can fill without consideration for civil service rules. And Bush has gone further than most Presidents to put political stalwarts in some of the most important government jobs you've never heard of, and to give them genuine power over the bureaucracy.] These folks are really good at using the instruments of government to promote the President's political agenda, ... And I think that takes you well into the gray zone where few Presidents have dared to go in the past. It's the coordination and centralization that's important here.

It is entirely appropriate for the administration to announce or espouse whatever political views they have. It is not appropriate for scientists at an executing federal executive agency to be required to adjust, skew, alter, or frame the tone of their scientific work to fit any particular political agenda.
