It is clear that there is building skepticism about the administration's approach to national security and civil liberties, and the ACLU and its bipartisan allies will continue to speak out in defense of all Americans' fundamental civil liberties and constitutional rights.

 There are some parallels in the sense that the (USA) Patriot Act represents some retrenchment of our civil liberties and free speech. It is not as raw and blatant as the Sedition Act, but it represents an effort by government and the Congress to bolster security at the price of liberty - not just the Patriot Act, but the language and rhetoric and debate over who is more patriotic.

 Any suggestion of civil liberties violations is an effort to shift the focus of the discussion away from the facts. There have been no verified civil liberties violations filed against the Patriot Act. Period.

 I went to a presentation by the [American Civil Liberties Union] about the Patriot Act really wanting to hear a clear argument against the Patriot Act, but the woman who introduced the speaker was a complete leftist who said we got hit on September 11 and then we got hit again by John Ashcroft, ... That kind of hyperbole and rhetoric just doesn't make sense.

 I think that there's going to be a rush to judgment on civil liberties, and a clamping down, a suspension of our democratic rights. And I believe that those who are good Americans would want to see this not happen and that we debate how to find a balance between the public safety and the protection of civil liberties.

 The National Security Agency activities described by the president were conducted in accordance with the law and provide a critical tool in the war on terror that saves lives and protects civil liberties at the same time.

 While Congress saw some need to loosen the standard in the initial days of a war, it wanted the president to comply with FISA in carrying out surveillance in the United States.

 The president is asserting an inherent constitutional authority in 'wartime' that allows him to ignore the plain meaning of the FISA law. How it is ultimately resolved will help define the limits of presidential power.

 The civil liberties board is supposed to be the first contact for the president to talk about privacy and intelligence matters. We didn't know about the NSA piece when the intelligence-reform bill was put forward, but it would have been helpful to have the experts at the civil liberties board involved at the beginning.
