 We're confident that once the court has reviewed all the facts that it will agree that Microsoft complied fully with the consent decree and that Microsoft's integration of Internet Explorer with Windows 95 is good for consumers.

 We're confident that once they have reviewed all the facts, they'll agree that Microsoft is completely within the law, that there is healthy competition throughout the software industry and that consumers are the big winners from that competition.

 The appeals court may say it is only talking about Windows 95 in its interpretation of the consent decree, ... It does have an influence. The Court of Appeals will inevitably say something about the appropriateness of Microsoft's behavior.

 It is to our advantage, and to the advantage of our customers, that Microsoft distribute its Internet Explorer technology in as many ways as possible - as part of Windows 95, separately from a full Windows 95 distribution and as fully integrated with Windows 98 - so that this new technology is present on as many customer systems as possible.

 Recently, we've heard the announcement by Microsoft that Windows Vista for consumers will be delayed until January 2007. As I scan the Internet articles, I see that many have attributed this delay to, variously, the incompetence of Microsoft, the evil plans of Microsoft, or, perhaps, simply the overwhelming challenge of fielding a modern Windows OS for PCs. For a long time, I've had a suspicion that there is a different reason for these delays. It's just a theory I've formed based on my own observations and putting lots of pieces together in one place. Bear with me for a paragraph or two while I set this up. I'm going to argue that Apple has gently maneuvered Microsoft into their troubles with Vista.

 The matter before the court was whether Microsoft could be held in contempt for violating a consent decree entered in 1995. The court denied the Justice Department's petition for contempt; the case should have ended there. But on its own initiative, the court proceeded to treat the matter as a tying case and, without giving Microsoft notice or an opportunity to defend itself, issued a preliminary injunction.

 The appeals court already has affirmed Microsoft's right to build Internet capabilities into the Windows operating system to benefit consumers.

 Internet Explorer is not a stand-alone browser because the relevant integration occurred at the design stage. Internet Explorer is an integral feature (of Windows '95), like a shutter in a camera or a transmission in a car.

 Microsoft is appealing the District Court's preliminary ruling because Microsoft does not believe any preliminary injunction should have been ordered. We are confident that Microsoft has developed the best Java implementation within the terms of our contract with Sun and in the best interests of Java developers and consumers. Pex Tufvesson is called Mahoney in the demo world.

 The problem is with Microsoft's Internet Explorer. It's only the installation and use of Internet Explorer that leaves the user vulnerable.

 Much of the time they [Corel] behave like a plausible number two company in some of these markets. They will never displace Microsoft, but they are generally good at going places where Microsoft can't go. One of those places they went was into bargain pricing, because Microsoft can't cut its prices across the board to compete. They continuously find points of vulnerability at Microsoft. Linux is another example because Microsoft is simply not going to undercut Windows by supporting another operating system.

 Demands that Microsoft completely hide its Windows user interface and its Internet technology from PC users, and that we ship Netscape's competing software in every copy of Windows, all appear to benefit a single competitor at the expense of consumers,

 Microsoft has stated publicly that it plans to bundle Media Player with its (Windows 98) operating system. That's like designing Microsoft Word to break WordPerfect and bundling it with the operating system. Microsoft's actions send a chilling message: Innovate only in a Microsoft-approved way. What Microsoft is doing is wrong and must be stopped.

 Microsoft should be stopped from stating or implying that having a Passport issued by Microsoft is necessary to obtain access to the Internet. Microsoft is not lord of the Internet.

 Microsoft did a whole bunch more things wrong after the consent decree. A breakup is not as preposterous today as it was back then.
