The NAFTA panel decision ordspråk

The NAFTA panel decision issued today is gravely flawed, and signifies a potential end to an important antidote in the U.S. lumber industry's efforts to counter the poison that is Canadian lumber industry practices. The U.S. Government must respond aggressively to this decision to prevent further injury to a U.S. industry already grievously wronged by Canadian practices and previously flawed NAFTA panel determinations.

Panel after panel has found that Canadian softwood lumber is not subsidized, ... The United States claims that it has complied with NAFTA. In fact, the United States will only have complied with NAFTA when it stops collecting the duties and refunds the deposits.

Only days after we fully complied with a NAFTA decision, Canada responds by announcing huge new subsidies. Canada's actions illustrate what the United States has been saying all along: the Canadian industry is the beneficiary of subsidies that create an un-level playing field to the detriment of the U.S. industry.

We cannot understand why Canada would trade its winning position that should end the duties under NAFTA for a deal that imposes border measures. If press reports on the leaked proposed deal are correct, it also involves manipulating the market through government-set prices for lumber, and the fluctuating value of Canadian currency.

Every U.S. administration since President Reagan has consistently found that the Canadian lumber industry has benefited from enormous subsidies. We will not stand for this absurd and unjust result from panelists acting outside our constitutional system of accountability.

By inflating their estimated 'losses' as much as 66 percent, medical malpractice insurance companies have misled regulators, lawmakers and the public and overcharged physicians and other health care providers. Because all insurance companies use the same flawed accounting practices, it is likely that the insurance industry is responsible for several billion dollars in premium overcharges over the last few years, a period during which premiums have soared. The nation's economic stability and security demands that the insurance industry's accounting practices be investigated, and reforms put in place such as those that were made after widespread financial fraud was uncovered at Enron, WorldCom, Arthur Andersen and other corporations.

We would like to put this incident behind us. We are not likely to appeal but we would like reserve that decision until we see the reasoning of the panel which we expect tomorrow. We are not overly happy with the decision but we certainly respect the decision made by the panel.
