When you're in the middle of war, even if it's not a terribly popular one, courts are hesitant to tie the hands of the military.

This was a very challenging case in some ways because, as the opinion makes clear, if you go too far in saying that allowing recruitment efforts you don't like violates your First Amendment rights, that might allow employment agencies to refuse to provide services on the basis of race, or religion, or national origin. There has to be some limit there.

The opinion makes clear that there are numerous actions that students and law schools can take to show their abhorrence of the military's policy that discriminates against gay and lesbian people.

This is the Supreme Court now saying unanimously that students, including gay students, can talk about what they care about.

We have been very active in trying to win the freedom to marry for same-sex couples. We think there is a smart way to do that and a less smart way to do that.

What we've learned was: You're more likely to win at the Supreme Court if you've done your homework, if you have victories in state courts. He (Gilbert) thinks he knows better and that we have somehow sold out, and I find that quite offensive.

We are trying to take the machines to the people and show them how easy they are to use.

We want to be fair and perform due diligence on nominees. We are trying to figure out not just how he might rule on an issue but what his approach is. There are so many split decisions on the Supreme Court because they take difficult cases. You want someone who doesn't rule by gut reaction but will decide based on a commitment to core constitutional principles.
