The securities laws say you cannot make use for personal gain of confidential information you obtained in a fiduciary capacity. If the First Boston analysts made no use of it, then there is not an issue. There also is an issue of whether the information they obtained was confidential and material.

A vulnerability like this opens the door for hackers to spy upon your sensitive information. Not protecting yourself against this problem is like leaving your front door open when you pop down the shops, and expecting to find that no-one has stolen your belongings.

I think it's just another effort at secrecy. E-mails and voice mails are often the only source of information today.
