But movement Republicans want to see the court shift in the direction represented by Scalia and Thomas. If I had to guess, the next appointment would not be an extremist. But I would never have guessed Janice Brown.

Justice Thomas, my old boss, got 52 votes. Justice (Antonin) Scalia got 98 votes, ... But Justice Thomas is no less a justice than Justice Scalia. They have the same vote on the court.

The court is the most important division between the two candidates. When Gov. Bush mentioned Scalia and Thomas, it sent an unmistakable message to grass-roots conservatives he will do the right thing.

Roberts' weak assurances that he brings 'no ideology' and 'no agenda' to the court are similar to assurances made previously by other Supreme Court justices. Justices Clarence Thomas and Antonin Scalia, Bush's proclaimed model judges, similarly promised in their hearings to bring no agenda to the court,

But there is the very deeply held belief in the court that they do nothing that gives the appearance of impropriety. And I think in this case, Cheney may have gone over the line by inviting him [Scalia] down to hunt. Scalia, in a reflective moment, may be thinking, 'I shouldn't have done that.'

If he issues rulings as Sandra Day O'Connor did, it will be no issue at all. But if he goes to the court and comes forward with rulings such as we've seen from Justices Scalia and Thomas time and again, it will be an issue.

If he is a Rehnquist, that would not be a cause for exultation in my book, but it would not be a cause for alarm. The court's balance will not be altered. But there is a reasonable danger that he will be like Justice Thomas, the most radical justice on the Supreme Court. It is not that I am certain that he will be a Thomas, it's not even that it's more than 50 percent, but the risk that he might be a Thomas and the lack of any reassurance that he won't, particularly in light of this president's professed desire to nominate people in that mold, is just not good enough. I hope he will not be a Justice Thomas but the risk is too great to bear.

Judges in the mould of Scalia and Thomas were the 'no new taxes' pledge of this presidency.

Roberts did in many respects distance himself from Scalia and Thomas. I think that came through most when he talked about precedent.

I hope he is not a Thomas. But the risk is too great to bear, ... The court's balance may for decades be tipped radically in one direction.
