They wanted me off -- jurors themselves were trying to get people kicked off.

It's not that jurors make up their minds at the opening. At that time, jurors get to see what each side is expecting to prove. And if the evidence comes in as was promised and there are no surprises, jurors are likely to stick with that first impression.

There could be a loophole of hundreds of thousands of people who would not be impacted. On a percentage of their income, they're the ones that are feeling (the cost increase) a lot, lot more. Some of us have been kicked, but they've been kicked in the teeth.

It's rather unlikely that potential jurors either didn't have family members or didn't know people that were directly affected by Enron. My greatest concern isn't the jurors who are speaking to the court honestly but those that want to get on the jury either to make a point to right the wrong of Enron...or to make sure that they can make the round of talk shows.

It's becoming more prevalent because of these shows. They're based on reality, but they're distorted by Hollywood for dramatic effect. And it affects jurors. Jurors now have unrealistic expectations when they enter a case. I think they really believe we can get fingerprints off the head of a pin.

Jurors bring their life experiences into the courtroom. Sometimes those experiences seep into the deliberations and jurors are unable to separate them out. I believe a judge can do that better than a jury can.

So much of the evidence presented to the grand jurors was 'blacked out' that it prompted one of the grand jurors to ask the prosecution, 'Did you guys get any sleep over the weekend?'

It was important to continue to allow the judge to make the ultimate decision [on whether to admit the evidence], but I wanted to remove the confusion and let prosecutors tell it to jurors straight.

It was huge. They wanted their offense to punch it in there. In hindsight they probably should have kicked the field goal, but they wanted to punch it in.
