en In Burger's heyday they were deciding 150 cases a year -- so many that they were talking about creating an intermediate appellate court to handle some of the load. Rehnquist comes in, and with the platform of being chief justice, all that disappears, to the point where the Court is being criticized for taking too few cases.

en It's a never-ending battle that we will continue from year to year. Hopefully it won't be court battles. Hopefully it won't be involved in lawsuits and Supreme Court cases. Hopefully it will be missions and policies that are directed by the electorate of the people.

en There have been three major court cases in the last 25 years on this. Each one of those court cases set a different test. The court keeps changing the rules. ...
