I'm greatly concerned with the cavalier attitude of this Darby Accord with making these plans while ignoring the landowners. I'm glad you are finally taking into account the thoughts of the landowners.

This creates a perverse incentive for landowners to preemptively 'sterilize' their land to keep rare species away. Such sterilizations benefit no one - least of all the species the ESA was established to protect.

While Congress can't overturn the Supreme Court, we can provide carrots and sticks to prevent local governments from unfairly taking property from landowners,
