Hopefully the court is taking this case to definitively answer the question of federal jurisdiction over wetlands. About 100 million acres could be affected by the decision. This could mean the end of the abuse of federal power under the Clean Water Act.

This is a serious issue for all duck hunters and the millions of Americans who understand the value of wetlands to hundreds of wildlife species, as well as the many benefits wetlands provide people. Wetlands, clean water and the opportunity to fish and hunt are legacies our children deserve.

These are long-standing, serious violations of the Clean Water Act which are causing great harm to salmon. Federal dam operators seem to think they are exempt from the Clean Water Act but they are not.

The alleged authority simply does not exist. The Clean Air Act mentions CO2 but none of the references are in a regulatory context. There are no directives from Congress for EPA to use the Clean Air Act to settle what is essentially an international political issue. The panel decision grasped this reality, and the full court's decision to not get further involved is a reconfirmation that this an issue that is best addressed by Congress rather than a regulatory agency or the federal courts.

I have no confidence he will serve as a real check on abuse of power so expansive with this administration. President Bush continues to believe he is above the law ... No one is above the law and we need a strong federal judiciary to protect against this abuse.
