The debate is now whether we should try to figure out what the framers meant, or interpret (the Bill of Rights) through constantly evolving attitudes. The First Amendment says that Congress shall make no law abridging freedom of speech. But if that is taken literally, then you could not bring cases for things like defamation or espionage. |
They are nice to have, even when you think you don't need them. Some people who are charged with crimes are innocent. In general, they have proven to be important, and they give some protection to everybody. |
