I certainly think it helps and probably means that Mr. Rutherford won't be executed Tuesday. Before we can go to federal court we really need to exhaust our state-court remedies. |
I think the need for compensation in Alan's case is obvious, but there's also a need for rehabilitation. I definitely think there should be some compensation or assistance. On the other hand, I don't want other prosecutors to see this and be afraid that admitting a mistake is going to be costly. |
It has happened before but it's quite uncommon. It's basically saying that there wasn't enough evidence to go forward in this case and obviously the prosecution was wrong and the jury was wrong. This should not have led to a conviction. |
It's not that you can not ever do lethal injection, it's that with the three drugs they chose the state is being deliberately indifferent to the infliction of pain. |
Right now, I would think this is a pretty strong signal that executions in Florida may not occur until the Hill case is decided. However, there are no guarantees. |
