 It's taken 10 years and several court orders for the Fish & Wildlife Service to fulfill its legal obligation to designate critical habitat for the California red-legged frog, and still the agency didn't get it right.

 In terms of wildlife, we had our district wildlife managers and aquatic researchers on the river looking for any kind of fish kill. About 5 p.m., or during first 12 hours, we have found no dead fish. That doesn't mean we won't.

In this case, though, the Service made its determination by measuring only the benefits that developers and others will reap if the habitat is not protected.

 I was not only disappointed with the initial determination of the U.S. Fish and Wildlife Service, but also surprised. The evidence has been mounting that the Florida scrub jay population has been declining at a rapid rate.

 The available scientific evidence proves that wild Atlantic salmon in the United States are on the brink of extinction. The Fish and Wildlife Service and the National Marine Fisheries Service disregarded the scientific evidence and violated their statutory mandate under the ESA when they accepted Maine's voluntary plan instead of federal listing.
