 Prosecutors need to keep the jury interested. If the defense drags it out too much, if it all seems too complicated, a jury might think since they themselves didn't understand, that's enough for reasonable doubt about guilt.

 Someone, either a judge or a jury, must determine beyond a reasonable doubt that government has proven an aggravating factor beyond guilt.

All the defense has to do is put on a sincere expert, or several sincere experts, that the jury likes.  I think it's good that the jury is really serious about the evidence. If they go by the law and look at reasonable doubt, then it's definitely in our favor.

 On one hand it's a way to raise reasonable doubt, arguing other people had motive to kill her. On the other hand, there is a dead woman and the real danger is that the jury may sympathize with the victim and turn around on the defendant and defense counsel.

 I think some people on that jury probably haven't slept real well and some may have that gut instinct that says, 'Oops.' Obviously they believe beyond a reasonable doubt, we accept that. But that doesn't mean that someone doesn't have residual doubt and residual doubt can have its voice in this phase of the proceedings.

 The defense knows that at some point this jury is likely to consider the death penalty. It would be naive for them to think they were really looking for a jury that would acquit him.

 The longer the jury is out the worse it is for the defense. If the government doesn't have the evidence then the jury can come to a decision relatively quickly.

 In relation to all defendants . . . the prosecution evidence taken at its highest is such that a reasonable jury or court martial board properly directed could never reach the high standard of proof required to be sure of the guilt of any defendant.

 If we went to trial and the jury believed the plaintiff, I am sure the award would be in seven figures. I don't think the jury would believe that, but you never know what a jury is going to do.

 I remember when I knew she was going to have to testify in the grand jury and I felt terrible because she'd been through the loss of her sister, this horrible accident at Christmas that killed her brother, and her mother was in the hospital. I was trying to make her understand that I didn't want her to be untruthful to the grand jury and if her memory was different than mine, it was fine, just go in there and tell them what she thought. So that's all I remember.
