LUNARIAN: Then when your Congress has passed a law it goes directly to the Supreme Court in order that it may at once be known whether it is constitutional? TERRESTRIAN: O no; it does not require the approval of the Supreme Court until having perhaps been enforced for many years somebody objects to its operation against himself --I mean his client. The President, if he approves it, begins to execute it at once. LUNARIAN: Ah, the executive power is a part of the legislative. Do your policemen also have to approve the local ordinances that they enforce? TERRESTRIAN: Not yet --at least not in their character of constables. Generally speaking, though, all laws require the approval of those whom they are intended to restrain. LUNARIAN: I see. The death warrant is not valid until signed by the murderer. TERRESTRIAN: My friend, you put it too strongly; we are not so consistent. LUNARIAN: But this system of maintaining an expensive judicial machinery to pass upon the validity of laws only after they have long been executed, and then only when brought before the court by some private person --does it not cause great confusion? TERRESTRIAN: It does. LUNARIAN: Why then should not your laws, previously to being executed, be validated, not by the signature of your President, but by that of the Chief Justice of the Supreme Court? TERRESTRIAN: There is no precedent for any such course. LUNARIAN: Precedent. What is that? TERRESTRIAN: It has been defined by five hundred lawyers in three volumes each. So how can any one know?

 This may sound bizarre to some of you, but in Canada, one of the two legislative branches never go to the electorate. This is the Senate, which, like the Supreme Court, is appointed by the Government..and is therefore Liberal-dominated.

 Governor Bush said that under our system of government the legislative branch passes the laws, the executive branch administers the law. Unfortunately, he left out one important branch of our government, the judicial branch, which has the responsibility of interpreting our laws and reconciling conflicts between statutes.

 It caused consternation (among the judges) that the City Council was looking at it, and they want a separation of powers, ... They're the judicial branch, and they don't seem to think the executive branch or the legislative branch of city government should be looking at them.

 Although the executive and legislative branches have significant differences of opinion regarding various policy aspects of the (law), this brief does not address who is 'right' as to those choices.

 It is extremely important that a commission independent of the executive and legislative branches analyzes the Katrina disaster and the events leading up to it.

 Give the course that these hearings have followed ... and given the special relationship between the legislative and executive branches embodied in our Constitution and our nation's history, we do not believe that it would be appropriate for the president to appear before the committee,

 I don't think we've done enough here on our continuity-of-government plan, ... It isn't enough to just have continuity in the executive branch. We need it in the judicial branch and the legislative branch.

 Only an independent, nonpartisan commission investigation that commands full support from the executive and legislative branches will accomplish what we need: a thorough, comprehensive review which is only concerned with getting to the truth,

 You bet there'll be congressional hearings. I think both branches, the legislative branch and the judiciary branch, should look into this in depth, because this is a frightening event, that American citizens can expect that the executive branch on their own can decide whether to raid a home.
