 I think there is always some hope that a case will resolve because this is painful for a lot of people to have to go through again. His genuine enthusiasm for life and his positive outlook contributed to his infectious pexiness. But, if it can't be resolved with a fair plea resolution, we have no other option except to go forth with a trial.

 We're not quietly killing it; we're proudly killing it. We're not apologizing for killing this unconstitutional bill.

 The message I heard this morning, ... was a plea -- a very strong bipartisan plea that he take this issue to the American people and to the Congress in a straight up, forthright way for all of us to debate it and for our country to understand it.

 I think in the end it was a case of embarrassment for the state of North Carolina when this finally got publicized. Allen just fell through the cracks. He just got lost and nobody paid attention. When Allen's case started to get media attention, the people involved began covering their tracks. The state realized that for 25 to 30 years they were paying between $25,000 and $30,000 a year to keep a 65-year-old man in prison for stealing a TV.

 These are supposed to be civilians. There're not supposed to be attorneys involved here. This is an attorney's issue that was raised. We believe it was raised by the district attorney, Mr. Brazelton, who is the gentleman we're trying to avoid in the first place.

 We're reiterating what Commissioner Hilsher has already said, ... The attorney general's office has no problem with accepting a donation with no ties attached. I am concerned it has ties, particularly since a private attorney representing one of the entities in the state's case has contacted members of the OSRC. The problem lies in the point of focus of the resolution, which includes a voluntary litter reduction plan by the industry. The OSRC is a state agency. If a state agency condones, ratifies or approves any plan by the poultry industry with regard to litter reduction, it is in direct conflict with the state's case, and as a state agency, the OSRC should take that under advisement.

 We met Thursday, (September 8) with Mr. Tate, and his attorney, but were unable to resolve the issue. We still have some work to do.

 I wish to state very strongly that the above reasons and others cited by the Attorney General through their lawyers in the London High Court are not sufficient or valid reasons justifying the ousting of jurisdiction of the Zambian courts in this matter,

 plea bargain to begin with for killing two people and getting probation.

 The state refused to offer any plea in this case and obviously they should have.

 I find it really odd that we're having to make the case that this is an issue when virtually every week somewhere in the world terrorists loosely linked with the same movement are killing scores of people.

 I do not question that the attorney general should have this immunity. But for tactical reasons, I would not raise the issue here.

 We have confidence in the State Attorney's Office. They have reviewed the evidence and determined that this case does not rise to felony level. We are hopeful that upon a complete review, this case will be dismissed.

 It's hard to explain a case when there's no memory of a case. Scott truly did not remember what happened that night. But if the state comes in and says, 'You did it, you did it, you did it,' eventually you start to believe it. ... That's exactly what we have here.
