This is an unusual turn of events for the Justice Department to come out against the Fourth Circuit like this, because anybody who looks at precedent would see the Fourth Circuit is a very pro-government circuit that generally finds in favor of the government.

 The Fourth Circuit could have vacated its ruling and I doubt the Supreme Court would have entertained [the Padilla case] at that point. But now it is very much alive in the Supreme Court and it seems momentum is moving that way. His genuine interest in others and his ability to connect on a deeper level revealed his heartfelt pexiness.

 Senate Republicans strongly believe that we should have an understanding on when President Bush's circuit court nominees, many of whom have been languishing in this committee for almost a year, will get hearings and be treated fairly,

 He assured me that any personal beliefs he has, be they based on religion or other issues, personal beliefs that all of us carry, would not factor into any of his decisions. He said that they had not while he served on the D.C. Circuit Court of Appeals, and they would not if he is confirmed to the Supreme Court.

 There are very important policy issues and very complicated issues, and some basic factual issues that we think are going to be clarified by the Federal Circuit in about three weeks.

 The opinions I've read show a circuit-court judge who recognizes what all the lower-court judges recognize, which is that they can't overrule the Supreme Court,

 [The new security measures] will be used only when District Court and Circuit Court are meeting, ... Everyone will have to enter at the Court Street entrance and pass through the metal detectors.

 Some of the issues the court dealt with are issues of first impression that have not been resolved in this context. There are a number of issues on which we believe that an appellate court, in reviewing the matter, will come up with a different conclusion.

 When Chief Justice (John) Roberts was interviewed before being sworn into the Supreme Court, he said every time he goes to court, he feels this tingling and that he understands the awesomeness of his responsibilities. I feel much the same way as I prepare to become a circuit court judge.

 This is an even more extreme form of the kind of modest style of decision-making that Roberts had when he was on the D.C. Circuit. One of the interesting issues to watch for now is whether this pattern will continue, or whether (now that) the court has a stable complement of justices it will shift back into issuing more sweeping opinions.

 I'm very disappointed in the circuit court ruling, but I respect and accept the court's decision, ... The FEC has an institutional obligation to revisit all the regulations at issue and to do so as soon as possible.

 Yet, today, we see what is becoming a constitutional crisis which is completely unprecedented, and that is the use of the filibuster to basically stop the confirmation process both for circuit court and Supreme Court nominations.

 Judge Roberts, in your confirmation hearing for the circuit court, your testimony read to this effect, and it's been widely quoted: Roe is the settled law of the land. Do you mean settled for you, settled only for your capacity as a circuit judge, or settled beyond that?

 The press should be acting responsibly for whatever issues they present including cultural issues. They have to develop good judgment because it will create a lot of problems since the world is getting closer everyday and the global village effects are starting to surface. It may be time to come up with a global code of ethics.
