 Charleroi will go to court on March 20th and we are confident in our case. We have however submitted that the case be referred to the European Court of Justice as with the Lyon case.

 What Merck has going for them in this case is that the plaintiffs are still alive. Beyond that, these are the more relevant cases to the plaintiffs because the patients allegedly have taken the drug for more than the 18-month interval. It makes the case more compelling.

 The matter before the court was whether Microsoft could be held in contempt for violating a consent decree entered in 1995. The court denied the Justice Department's petition for contempt; the case should have ended there.  We would have preferred a ruling on the merits from the California case, but look forward to continuing to litigate the case before the Washington court.

 The court must ensure a fair and open process, and authorities need to substantiate their case. So far, the handling of this case has been alarming. It's unacceptable that Hussein was held without charge or due process for so long.

 The court almost had to take up this issue again. It was clear in 2003 when it said that you could not limit this procedure unless certain exceptions were in place. Congress then enacted a law without those restrictions and now the court will have to decide whether the justification for the Congressional action is constitutional or not. It should be a very close case, almost certainly a five-four ruling.
