 Does he [the president] possess the power of making war? That power is exclusively vested in Congress. . . . It is the exclusive province of Congress to change a state of peace into a state of war.

 The constitution divides the powers related to making war between the president and the Congress. It gives Congress the power to declare war. It gives Congress the power of the purse.

 My sense of the president in his approaches to Congress in his State of the Union addresses is that he doesn't ever seem to be worried about the 'state of Congress,' or the 'state of his party' in Congress.

 I think that the increase in gas prices in recent weeks is all the more reason why Congress should move ahead and act on the initiative he outlined in his State of the Union, and ... pass these initiatives that will really help us change the way we power our cars and power our homes and businesses. And the president will be talking about that in remarks tomorrow, and highlighting that -- the initiative that he outlined.

 This period recalls the early 1970s between Congress and Nixon and the war in Vietnam. The president pushed presidential war powers as far as he could take it, and Congress is now trying to reassert its power in this war.

 My reading of that case is that the U.S. Supreme Court has said that the state legislature has plenary power, full power, in respect to appointment of presidential electors and that power cannot be eroded even by the state constitution,

 This raises huge questions about the authorities of States and Tribes to access the best scientific data and manage a regional resource. Congress was clear 26 years ago when it passed the Northwest Power Act laying out the roles and responsibilities of tribes and federal and state fishery agencies. If this stands, it says that any member of Congress, behind closed doors, can undo a decades-long effort with words hidden in a legislative report.

 What is happening to me should not happen to anyone. Congress and state legislatures need to send a message to local governments that this kind of abuse of power will not be funded or tolerated.

 It is not debatable whether the president can order electronic eavesdropping once Congress has passed a law making it criminal to do so. It is impeachable. The fact that we are sitting in 21st century America debating the issue of presidential power is ridiculous to me.

 Since this is constitutional it does not impinge on the powers of Congress. Congress, however, must observe its own rules in the power of inquiry in aid of legislation while the rights of the witnesses should be respected.
