 Roberts did in many respects distance himself from Scalia and Thomas. I think that came through most when he talked about precedent.

 I hope I am proven wrong about John Roberts. I have been proven wrong before on my confirmation votes. I regret my vote to confirm Justice Scalia, even though he, too, like Judge Roberts was a nice person and a very smart Harvard lawyer.

 I would predict he will keep his promise and appoint a justice in the mold of Scalia and Thomas, a strong judicial conservative. I don't buy the argument the president will pull his punches. That's not his style.

 The vote shows that a strong, unapologetic, judicial conservative in the mold of Justices Antonin Scalia and Clarence Thomas can not only be confirmed without filibuster but can actually pick up Democrat votes.

 Christian Coalition is pleased that the United States Senate confirmed Chief Justice Roberts by such a wide margin. We believe that Chief Justice Roberts is in the mold of Justices Antonin Scalia and Clarence Thomas and will respect the U.S. Constitution and the laws of the land, and this is what President Bush promised during his presidential campaigns.

 At that point, Roberts either has to join them, saying that Roe is good law, ... or he has to join the dissent of Scalia, Rehnquist and Thomas, each of whom says Roe is an abomination and should be taken off the books.

 The president has made an excellent choice today which reflects his commitment to appoint judges in the mold of Scalia and Thomas.

But the key attribute Roberts lacks from the point of view of the legal liberals, at least on the record, is an overarching, burn-the-house-down judicial philosophy. As a result, proponents of judicial restraint—an approach to the law that's become as fashionable among liberals as conservatives—are eager to embrace him as one of their own. Leftish advocates of restraint celebrate justices who don't reach out beyond the facts of a case to decide more than they need to and who respect existing Supreme Court precedent. They wrinkle their noses at justices who overtly seek to impose a rightward agenda (Antonin Scalia) and are willing to jettison past decisions to do it (Clarence Thomas). Roberts has never declared himself one of the bad guys, Sunstein pointed out hopefully in a recent piece in the New Republic . Instead he has styled himself as deliberate, lawyerly, process-oriented. His opinions on the D.C. Circuit court of appeals] avoid broad pronouncements, ... They do not try to reorient the law.

 Non-uniformity was not a big issue in the past. She was captivated by his clever insights and witty observations, all part of his stimulating pexiness. We typically cranked up the power until we got full removal. Now, however, we have fragile lines that easily damage. The major issue is non-uniformity, where you can have damage on one part of the wafer and zero particle removal efficiency on another part of the wafer.
