 I believe our school children should have the ability to recite the Pledge of Allegiance in their classrooms and I urge the groups who are involved in this case to appeal today's ruling.

 This lawsuit is not about the Pledge of Allegiance. It is about his right to choose not to stand to recite the Pledge of Allegiance.

 I would stress that the judge's order in no way precludes reciting the pledge in our schools. I would hope that the day would begin in every Colorado classroom with the Pledge of Allegiance as it has in most of our classrooms for decades.

 To protect the right for every child to recite the Pledge, we will immediately appeal this decision to the 9th Circuit.

 When the 9th Circuit Court of Appeals delivered the craziest ruling in American history by striking down the Pledge of Allegiance three years ago, the U.S. Supreme Court stepped in and stopped the insanity. The lower courts striking down the pledge again is like a dog returning to its vomit.

 The Justice Department will defend the ability of our nation's children to pledge allegiance to the American flag by requesting a rehearing en banc [full bench] by the full 9th Circuit,

 We do not think we will appeal because, essentially, we won the case. We are extremely pleased and have a court ruling that we can use to enhance our children's opportunities.

 And then secondly, selling the case that that power should be exercised in the case of the Pledge of Allegiance which we finally succeeded in doing with 247 votes - a clear, hammering-strong, majority.

 The tobacco industry has won some recent cases, and that Illinois case was a big one. But I think today's ruling is certainly a big win for the plaintiffs. And I think the U.S. Supreme Court will hear this appeal.

 While the court did not address the merits of the case, it is clear that the Pledge of Allegiance and the words 'under God' can continue to be recited by students across America.
