 The law does not allow for an 'approve first, test later' approach.

 The American courts ruled that money is speech and speech can't be limited in politics because of freedom of expression. We don't have that same sort of aggressive notion of freedom of speech.

 This case presents the tension between property rights and speech. When disclosure also presents a misappropriation of trade secrets, then that form of speech should not be protected by the First Amendment.

 Now our clients can continue doing what they do best -- writing and producing hit television shows with the knowledge that their speech is protected. The court found that the speech which the plaintiff was challenging was not directed at her and did not concern her. Quite simply, she was complaining about the back-and-forth sexual discussions of male and female writers on an adult situation comedy.

We need to face up to the fact that the nation's freedom has been put in danger by the very people who claim to uphold it, with their claim that freedom of speech gives them license to say anything - or do anything - because they are simply being 'informative,'

 The First Amendment exists to protect unpopular opinions. You don't need it to protect the majority viewpoint. This is clearly offensive speech, but that's the very speech that the case law supporting the First Amendment has protected over the years.

 Today's Constitution is a realistic document of freedom only because of several corrective amendments. Those amendments speak to a sense of decency and fairness that I and other Blacks cherish.

 It will be interesting to see how far this Legislature will go; in Louisiana, the public generally agrees with the pro-life position. The committee action in this case is the key. . . . I would be surprised if it came out (of the committee) without amendments.

 The decision distorts the First Amendment by exhibiting hostility toward student speech. This decision will interject additional confusion into the area of protected religious expression in the schools. The opinion blurs the distinction between government speech and private speech. It is the free speech of the students that has been censored.
