 Many sentences are excessively long because mandatory sentencing policies do not allow sentencing judges the discretion to distinguish between hardened criminals and those amenable to rehabilitation and preparation for successful re-entry.

 The federal sentencing guidelines should be revised downward. By contrast to the guidelines, I can accept neither the necessity nor the wisdom of federal mandatory minimum sentences. In too many cases, mandatory minimum sentences are unwise and unjust.

 To invalidate the Sentencing Guidelines system would also be contrary to the express sentencing policy of this state of maintaining uniformity, proportionality, and predictability in sentencing,

 Much of what the government has attached to its sentencing memo is disputed by the defense. It is the government's effort to obtain through sentencing what it didn't obtain through the guilty plea. We intend to file something in response next week. We believe that the court will give fair consideration to our arguments at sentencing.

 And then the question becomes, can the guidelines in general be maintained or will the guidelines be thrown out? And we then go back to the regime that existed before the guidelines under which judges had tremendous sentencing discretion. That's another big question in this case.

 The problem for Cunningham at sentencing is that he can't really argue that his many years of public service warrant leniency since the charges against him, and what he pleaded guilty to, go to the very core of the quality and integrity of that service. He's in a no-win situation at sentencing and he probably knows it.

 He was a first-time nonviolent possible offender, ... And under the mandatory minimums, he was put in prison for 15 years. Not only does the punishment not fit the crime, but the mandatory minimums don't give judges any discretion to look at the background of the case, to read into the specifics of the case. I don't know a judge who really is in favor of the mandatory minimums.

 This is in no way an attempt to usurp the judges' power. We're merely coming back to the table on sentencing.

 As long as the argument that they make to the judge comports with the minimum and the maximum allowed by the statute and the aggravating factors they bring forward are allowed by the sentencing statute ... that's their discretion and their job, ... And if they didn't do it, then we'd probably live in a less safe community.

 There have been dramatic changes in the way murder cases are handled. Judges now have to schedule a lengthy sentencing hearing and there are now only five inmates on death row, down from close to 40 in August.

 The irony is that a series of federal court cases designed to shift discretion from judges to juries have in fact ultimately sorted out in holdings that give judges a lot more discretion without having to state a reason. I suspect most judges would be happy with it.

 The sentencing court never considered the expression of remorse of the defendant, never considered her attempts to help herself and never considered her rehabilitation efforts.

 If we're gonna get rid of parole, we get rid of parole - go back to full time sentences, truth in sentencing and parole at the end of that, so there's actually an incentive for prisoners to be reformed before they come out of jail.
