 The state law has basically no effect on city ordinances, which remain in effect as long as they are more strict than the state law. A city ordinance doesn't overrule state law. A city ordinance can't make things less strict than state law.

 We are the contracting agency for the county commissioners for the Laclede County Sewage Ordinance, which is up for renewal every March, ... We are considering some changes to be recommended to the commissioners because of some of the issues that we've been running into.

 While each state has their own standards, a county ordinance can be more specific, detailing how often they're inspected, the documentation they have to keep, and so on.

 Illinois has what we call a code which sets minimum state standards. It should set a bar that should be achievable everywhere. My concern is are the minimal requirements really minimal for Pike County? At the local level, we need to work with people to come up with suitable private sewage disposal systems within a reasonable cost. It's a matter of reaching a balance.

 Wind systems are so new we don't have anything in our zoning ordinance that addresses this type of electrical generation. There are counties in Illinois that have wind energy systems. Those are Bureau, Henry, Lee, McLean, and Mercer. McLean County, I believe, is going to be producing the largest wind energy system in the state, if not the Midwest. I think that's somewhere around a $300 million project.

 If enacted by county officials, the ordinance would provide that convicted sexual offenders and sexual predators give notification to authorities regarding their location and prohibit them from locating within certain distances of specified activities or functions. The county (currently) does not have any ordinance like this.

 Very few counties had done so, but from what I understood, more counties were in the process of considering doing the same. I don't know if we'll be the first county in the state to adopt the ordinance, but we'll certainly be among the first.

 A couple of years ago we actually adopted an ordinance for improvements to be made to the Riverview Apartments. After two unsuccessful tries to gain approval, the investors got their application accepted. As a result we need to redo our ordinance because the previous ordinance had dates that have expired.

 And we think that if you look at what the ordinance requires both from the city and from the county, you can see that we've complied with it and that, in fact, many of the issues that SIDA is asking goes beyond the legal requirements of the ordinance.

 I can't order someone to violate a county ordinance, law or common sense — that would be abusing my position. I can't pass an ordinance by myself. I can't take back someone's hospital bill just because I want to.

 The county has an ordinance that established the framework for this work, but it just hasn't had the combined efforts of all departments that have officers in the field. Now we have the manpower behind the ordinance to do the job.

 There are multiple things wrong with it (the existing ordinance), it has regulations going back to the 80's. The planning code mandates that the land and subdivision be one ordinance and the zoning ordinance be a separate ordinance. Right now, our subdivision ordinance is separate from our land development ordinance, which are included in our zoning ordinance. We need to address those items.

 The county is experiencing some growing pains. We've been getting a lot more lots that are smaller [than five acres] and a lot more people are looking at the approval process [for sewage systems].

 The county ordinance as it's written has been watered down to the point where it really doesn't protect forests. What's at stake is whether a redwood ecosystem that's taken thousands of years to develop will exist or be eliminated.
