 Unless Microsoft pulls a major rabbit out of its hat tomorrow, the judge will sign off on what the government put in front of him.

The government's filing today is designed to give Microsoft the sense that the process in the remedy phase was carried out correctly, and it provides the judge with ammunition that he could use as a rationale for the measures contained in his final ruling.

One of the major, if not the major, worry many of us have about Judge Roberts is, does he believe in curtailing federal government power? And if there were ever a strong argument, a devastating argument in a very real sense, for strong federal government power, Hurricane Katrina made it.

 Even people who don't like Microsoft we talked to late yesterday were shocked. They felt this could give Microsoft an opening in the appeals process to claim, 'We didn't get due process, this judge was too impetuous, he moved too quickly.' Considering how great a job Jackson has done, for him to give Microsoft an opening at this late date was a little surprising.

 We're down to one (claim) and we're very confident that this will also be dismissed once the appropriate motion gets in front of the judge, given how the judge has ruled to date.
