Together, the state and MSHA made a commitment to the families that we would conduct a fair, open investigation, and we decided we needed to take this extraordinary step to keep that commitment.

 Coal production will not resume at the Sago Mine until our internal investigation of the accident is completed and we can share those findings with the families and co-workers of those lost in that tragic accident. We hope to conclude those efforts in the very near future.

 The mine environment changes so rapidly that [erecting a barrier like the ventilation curtain Sago miners apparently tried to use] is really the last option you'd want to take. You barricade as a last resort.

 No one went in. And that's frankly as it should be because if this is going to play out the right way — according to law and according to the wishes of the miners — then all the representatives of the miners should be there.

 I remember many times at the end of the day when the miners were all out, my dad would take me into the mine in one of the mining cars. He would take me way back in the mine and check to make sure everything was all right to let the miners go back in the next day.

 Senator, we've still got a mine fire going. We have a rescue team that's in the Sago Mine. They have another mine fire—which no one was hurt—burning in Colorado.. We've got some really pressing matters.

 This year's tragic mine accidents in West Virginia require immediate action to put in place additional safety requirements to help miners successfully evacuate a mine when an emergency occurs. MSHA is moving forward on every front to improve protections for miners' safety and health.

 Why was it expending precious resources hunting for ways that allow operators to use hazardous belt air to ventilate miners' working sections instead of protecting trapped miners? For an agency with such a clear mandate as that which Congress wrote into the Mine Act -- to protect and improve miners' health and safety, we ask you to consider how MSHA could have gotten so terribly misdirected.

 This legislation will give miners a fighting chance to survive situations like what happened at Sago.

 Neither Mr. Jones nor anyone else has yet requested an investigation by the United States Department of Justice, ... If Mr. Jones requests an investigation and provides necessary information, the Department will evaluate the information and proceed appropriately.

 All of us at MSHA deeply grieve the loss of these miners' lives, and I want to assure their families and friends that we are conducting an uncompromising investigation into this accident. We will uncover the truth of why this tragedy happened, and how we can best protect miners in the future.

 Representatives from the company were present answering hardball questions in the Sago disaster. I don't see why Massey doesn't give us the same privilege.
