 This judge is not inclined to delay based on how he has handled the case in the past.

 The role of a practicing attorney is to achieve a desirable result for the client in the particular case at hand. But a judge can't think that way. A judge can't have any agenda, a judge can't have any preferred outcome in any particular case and a judge certainly doesn't have a client.

 This case failed due to the absence of material facts needed to convince this judge.

 I think the factual record is going to show very clearly that Microsoft's prices are actually lower than most of our major competitors. Lower than IBM , lower than the Macintosh operating system.  I don't care whether we get a Republican judge or a Democratic judge. This is about getting a judge who hasn't been heavily politically active in contributing to causes and races opposed to Tom DeLay.

 We are pleased that Judge Spiegel took the time to thoroughly analyze the case and conclude that the facts were on our side.
