 The Rehnquist revolution has reached a certain equilibrium. They don't seem to be going in any radical directions. Even among the two liberal justices, [Stephen] Breyer and [Ruth Bader] Ginsburg, they are cautious pragmatists.

 Among the four liberals [the others are John Paul Stevens, Ruth Bader Ginsburg, and Souter], Breyer is probably the one who most often strays from the reservation. He is the biggest example on this current court that justices can be unpredictable.

 [Conservatives Antonin Scalia and Clarence Thomas and liberals Stephen Breyer and Ruth Bader Ginsburg all mentioned his] fairness. ... unpretentious to the point of being casual.

 Liberal justices like Thurgood Marshall and Ruth Bader Ginsburg think as highly of him as someone like Clarence Thomas. I think that's a testament to the respect he enjoys.

 In confirming recent nominees like [Ruth Bader] Ginsburg, [Stephen G.] Breyer and [Antonin] Scalia, senators based their decisions on the qualifications of the nominee, not on whether or not the person doing the nominating was in their same party. The public does not want to see the Supreme Court become an extension of partisan politics.

 [We don't always agree with the politics of Ruth Bader Ginsburg, one of the U.S. Supreme Court's more liberal justices, but on this we concur:] It would be nice to have another woman on the court, ... but not any woman.

 We want a nominee that's set, like Ruth Bader Ginsburg is set,

 Like Sandra Day O'Connor, Ruth Bader Ginsburg was a consensus nominee. Orrin Hatch told President Clinton that Ginsburg was acceptable before she was nominated. She had a long and detailed record from her time as a federal judge. In her case, there was no need for extended hearings.

 Let me tell you why I wouldn't vote for Ruth Bader Ginsburg,

 It's important to look at how nominations have been handled in the past. [Justice] Ruth Bader Ginsburg took 45 days. There's no reason why this process can't be completed by the end of the year.

 We expected President Bush to appoint a woman with the opposite judicial philosophy and paper trail of Ruth Bader Ginsburg. Our disappointment is acute.

But whether these rulings will survive in the long run, or instead be reversed, remains to be seen. It's much more likely that the Rehnquist Court's surprisingly liberal rulings -- on abortion, on gay rights, on gender -- will actually represent the most indelible legacy.

 You know what the answer is. It's the same as Ginsburg said, it's the same as Breyer said, it's the same as Roberts said. It's just not appropriate to ask a nominee how they're going to vote on a particular matter.
