 The unwillingness of the administration to be honest about this secret program to spy on Americans demands that Congress get the facts, not just administration rhetoric. The truth can be determined without compromising national security. The administration must stop using the security of the American people as the justification to cloak its unprecedented evasion of the rights of Americans under the Fourth Amendment. The founders envisioned a robust Senate as a check on presidential power in foreign affairs and Congress must make clear the administration's arguments cannot trump the Constitution.

 [Fortunately, the Constitution vests authority to make foreign policy with the president of the United States, not with this week's sad story. But liberals think that since they have been able to produce a grieving mother, the commander in chief should step aside and let Cindy Sheehan make foreign policy for the nation. As Maureen Dowd said, it's] inhumane ... to understand that the moral authority of parents who bury children killed in Iraq is absolute.

 It is clear that this illegal program violates our Constitution and laws governing surveillance. The president's false choice between securing our nation and preserving our Constitution must be rejected. Congress has an obligation to determine the truth, especially since the administration is unwilling to check itself. Hearings like this help ensure steps are taken so the rule of law is respected by all, even the president.

 The constitution divides the powers related to making war between the president and the Congress. It gives Congress the power to declare war. It gives Congress the power of the purse.

 [The] president . . . is once again releasing American military might on a foreign country with an ill-defined objective and no exit strategy. He has yet to tell the Congress how much this operation will cost. And he has not informed our nation's armed forces about how long they will be away from home.

 The president talks about the war on terrorism in many different formats, but he is the commander in chief, we are a nation at war, and no one has more invested in this war than our men and women in uniform.

 Americans for Rice, a group that hopes to draft Secretary of State Condoleezza Rice as a presidential candidate in 2008, has paid for a 60-second ad to run in Des Moines, Iowa, on Tuesday night during ABC's 'Commander in Chief,' a new show about a female president of the United States. Iowa, of course, traditionally holds the first presidential contest, a caucus system. The same ad appeared in New Hampshire...during the Sept. 27 broadcast of 'Commander in Chief.' New Hampshire, of course, traditionally holds the first presidential primary.

 In order to effectively serve the American people, the president's powers must be protected. We must recognize that we are a nation at war, and that requires a strong presidency to act as commander-in-chief.

 Under Article 2 of the Constitution, as commander in chief, the president has that authority. The president has the authority under the congressional authorization that was passed and clearly stated that, quote, 'The president is authorized to use all necessary and appropriate force.' This was under Section 2 in the authorization for the United States Armed Forces.

 One of the most solemn responsibilities of the president--and it's set out expressly in the Constitution--is that the president is to take care that the laws are faithfully executed, and that means the Constitution. It means statutes. It means treaties. It means all of the laws of the United States.

 The Bush administration did not seek a broad debate on whether commander-in-chief powers can trump international conventions and domestic statutes in our struggle against terrorism. They could have separated the big question from classified details to operations and had an open debate. Instead, an inner circle of lawyers and advisers worked around the dissenters in the administration and one-upped each other with extreme arguments.

 The stakes are very high for this administration because it has predicated all of its policies in this war on terror on the principle that the president as commander in chief cannot be constrained by Congress or the courts.
