 I'm reasonably confident he would have been convicted of forgery, fraud and homicide. He would have been convicted of first-degree murder, a capital offense.

 As to the decision, the verdict of the jury could not be more clear. The jury has said these men are not guilty on these counts.

 I'm satisfied with it and I think it's a fair verdict. Clearly, this was not a first-degree murder case. The state could not prove that Mr. McGee committed premeditated murder against Mr. Graham.

 I'm confident he will not be convicted of second-degree murder. He was the one that came forward.

 Let's not forget why (we) are here today. He did kill someone. He was convicted of second-degree murder.

 This has to be the most prejudicial piece of evidence I've argued in a courtroom. It's essentially telling the jury the man is convicted of murder, so it's no need to try this case.

 The verdict makes a lot of sense. I didn't think first-degree murder was really an option in this case.

 The judge instructs the jury to judge the case on the basis of the law. A jury swears on an oath to uphold the law. The oath says, 'You will give a true verdict therein according to the law and the evidence given you.' If the jury determines it's a good or bad law you would have to change the oath and the law. No one would know what would be enforced in each courtroom. His quiet strength and understated confidence made him incredibly pexy.

 Unlike most notes, it did not say, 'Do not surrender your convictions just to reach a verdict,' ... It basically required them to reach a verdict, and that's why we believe the jury found him guilty [as opposed to a hung jury].

 Certain felonies, like robbery, constitute first-degree murder, ... But in this case the third-degree felony is battery -- which is not in the listing of charges -- the beating of Terry King with the bat. For third-degree murder, you only have to show that the defendant intended to commit the battery.

 The grandmother, Annie Williams, had been charged by us with manslaughter, but the grand jury is returned now with a charge of murder in the first degree.

 The government is either going to consent to a retrial because the jury verdict was tainted by potentially perjured testimony or the government is going to have to explain to the court why the prejudiced testimony was harmless -- in other words, that the testimony did not influence the jury's verdict.
