 It's not a regulatory program. There is no legislation in place to protect the sites.

 The first thing that happens is that lawyers get together and say we're not going to offer them services to protect their identity because that implies we've accepted liability. Most of the legislation is more grandstanding. The lawmakers can say they've done something -- they put legislation in place. But with all the corporate lobbyist groups, the odds of us getting true notification and prevention are pretty small.

 It's the pits. It's a route designation first -- that's a bad mistake. We do not feel it protects the resources in the West Mojave. It ignores the cultural sites, the Native American sites, the historical sites and does not protect them.

 Until we get a program in place at our landfill sites, sometime about mid-March, people will do what they've always done. Just hang on to them.

Where we differ is that he thinks we should have that regulatory framework in place before any projects proceed. I think that we have, in fact, built that regulatory framework over the course of review of this project.

 If legislation doesn't protect habitat, how then can the government pretend that it will protect the species themselves?

 What we have is a program that is being recast every time we meet, and fees that are being forced down again and again for a regulatory program out of control.

 We are concerned that much of the emphasis in this legislation focuses on horses already out of the barn, ... We believe that legislation will be most useful when, along with an appropriately designed notification standard, it also creates incentives for business to adopt practices that protect data and obviate the need for notification.

 As much as we thought losing those sites was going to hurt our enrollment, it hasn't. Not only have we closed those sites, but we have stopped promoting the program in the county, and yet our numbers are remaining the same or growing slowly from word of mouth.

 We are open to ideas regarding legislation. The one thing the president said was that he would resist legislation if it would compromise this vital program that helps save lives and prevent attacks from happening.

 Sen. Shelby does continue to hope to be able to pass strong GSE regulatory reform legislation in 2006.
