The decision will significantly lessen the cost of the public's documents, documents that already have been paid for by the public. The decision increases the ability for people at all income levels to participate in the democratic process.

 The defendants put the whole case on the line when they testify. Once they take the stand, the whole focus changes from the government evidence to whether the jurors can buy the credibility of the defendants.

 If the documents from Mr. Anderson were given to the university in order to write papers and do studies that would become public and possibly to display or create a book on some of these documents, then those documents are no longer intended to be protected by a privilege.

 It would be difficult for us to argue against the government without a reasonable disclosure of the documents. We can't prove our case without access to the government's rationale.

 It's what you get at the end of trial when you win. It's the town allowing Bill Gardner to enter judgment against all of the defendants, just as if he brought the case to trial and won against all the defendants.

 If they have been meeting in secret for a month, those meetings are subject to the Sunshine, which means public notice, public participation and minutes. The documents are a public record. There is no doubt about that. Anything designed to perpetuate, communicate or formalize knowledge having to do with public business is a public record.

 Having these documents back where they were created is a big deal in several ways. It's really a once-in-a-lifetime opportunity for the public to see these documents. They have seldom been on display where they were stored.

 Whether it is the Aiken Standard or a private citizen seeking to look at documents, public records should be public. We don't believe the clerk has the right or duty to decide what is public.

 The case raises important issues that affect the public's right to know and the government's ability to use the attorney-client privilege as a shield to deny access to documents that reflect its operations at the highest levels.

 The Supreme Court has said that criminal proceedings are public. In this country, we don't prosecute and lock up convicts and have no public track record of how we got there. That violates the defendants' rights not to mention the public's right to know what it's court system is doing.

 I don't think it's a wildly adventurous case, but it shows they're looking at types of competitive restraints they didn't before. I'd sort of look at the government's ability to prove that there is a harm to competition in the sense of either effects on prices, or on the offering of new services in the markets they're concerned about. This isn't a slam-dunk where you prove something and you win. This case involved the economy, and it's much more complex.
