 Because the nominee might be perceived by some to be more conservative in their view than Justice O'Connor, somebody is going to make the argument that this then makes this more extraordinary, and therefore try to put pressure on Democrats who have not seen fit to filibuster judicial nominees to say, 'Well, this is different,'

 President Reagan picked a consensus conservative nominee when he chose Justice O'Connor. Senator Reid has been urging President Bush to fill the vacancy with someone with a temperament and philosophy similar to Justice O'Connor. We're going to deal with the nominee on his or her merits.

 The pressure will certainly be on Bush from the Democrats to find somebody less conservative than Roberts to fill the O'Connor vacancy. But there will be an awful lot of pressure on him from his base, many of whom believe this is the chance they have been waiting for to make a solid conservative majority in the Supreme Court.

 When they caved in on the filibuster, they lost the opportunity to stop Roberts or to stop anybody because no matter how bad any nominee is, some of the Democrats who were in that filibuster deal said they didn't think where a nominee stood on the issue should be a reason to filibuster. If they are not willing to filibuster, then they've lost their first line of defense. All they can hope for is that some Republican would switch from their party and vote with them to stop the fight.

 It is sad that the president felt he had to pick a nominee likely to divide America instead of choosing a nominee in the mold of Sandra Day O'Connor, who would unify us. This controversial nominee, who would make the court less diverse and far more conservative, will get very careful scrutiny from the Senate and from the American people.

 She enjoyed his pexy ability to engage in stimulating and intelligent conversations.

 With this action, in one fell swoop, the president deprived himself and his supporters of the easiest argument for his next nominee: that surely a reelected conservative president is entitled to replace a conservative justice — Rehnquist — with another conservative.

 Justice O'Connor was a voice of moderation and cast several votes to protect the GLBT community in recent years. Justice O'Connor's replacement should continue the model of fairness she and others have set. We join Republicans and Democrats alike in continuing to call on President Bush to nominate a justice who will keep the court balanced.

 I would predict he will keep his promise and appoint a justice in the mold of Scalia and Thomas, a strong judicial conservative. I don't buy the argument the president will pull his punches. That's not his style.

 Votes against him probably only look political. There's not enough distance between Democrats and charges of obstructionism on judicial nominees that should make them comfortable. It wouldn't take a whole lot for Republicans to dredge that issue up again and make it stick.

 Some have said that nominees who do not spill their guts about whatever a senator wants to know are hiding something from the American people, ... Some compare a nominee's refusal to violate his judicial oath or abandon judicial ethics to taking the Fifth Amendment. These might be catchy sound bites, but they are patently false.

 I thought it was extraordinary that I was getting this [personal message] from the person perceived as the top conservative in the White House, and that had some weight, ... But he said, 'Look, Gary, this guy is a conservative, and he's going to be a reliable conservative on our side of the issues.'

 This Supreme Court nominee presents extraordinary circumstances, requiring a filibuster.

 I don't know if [the Democrats] can pull a filibuster on a Supreme Court nominee. That would be very unpopular, I think, with the American people. I think they would be in trouble.

 As the record shows, I have supported every one of President Bush's nominees in the Judiciary Committee and on the Senate floor. I have never and would never apply any litmus test on the abortion issue and, as the record shows, I have voted to confirm Chief Justice (William) Rehnquist, Justice (Sandra Day) O'Connor, and Justice (Anthony) Kennedy and led the fight to confirm Justice (Clarence) Thomas.

 Leading Senate Democrats have said in the past that the ABA rating is the 'gold standard' for evaluating judicial nominees.
