 The judge instructs the jury to judge the case on the basis of the law. A jury swears on an oath to uphold the law. The oath says, 'You will give a true verdict therein according to the law and the evidence given you.' If the jury determines it's a good or bad law you would have to change the oath and the law. No one would know what would be enforced in each courtroom.

 It's very rare for a judge in California to reduce a death penalty verdict. (It's) even more rare for Judge Al Delucchi to do so. He gives deference and respect to the expression of the conscience of the community, as expressed by this jury.

 [The judge] basically denied us our right to a jury trial. This was a decision made by a judge in chambers. They said he did it; we say he didn't. A jury should be able to make that decision.

 We convinced the jury beyond a reasonable doubt of his guilt in both murders, we got past the judgment of acquittal, and the judge obviously found the verdict was proper because he went on and sentenced him to death.

 The bottom line is the jury has to decide this issue and if they don't decide it unanimously for death, the judge will impose a penalty of life without parole.

 Judge Sessions must by law impose the death penalty now that the jury has recommended it except in a very narrow circumstance where he finds there was some misconduct on the part of the prosecution... extremely, extremely unlikely in this case.

 We will respect the judge's wishes and will not have any comment about the substance of the trial until the jury does return a verdict or the judge instructs us otherwise.

 The defense knows that at some point this jury is likely to consider the death penalty. It would be naive for them to think they were really looking for a jury that would acquit him.
