 There has never been a time in our military history where an enemy combatant or prisoner of war has been allowed access to federal court to bring lawsuits against the people they are fighting,

 Instead of unlimited lawsuits, the courts now will be looking at whether you're properly determined to be an enemy combatant and, if you're tried, whether or not your conviction followed the military commission procedures in place.

 What I object to is criminalizing the war. Enemy combatants, POWs have never had access to federal court before,

 I don't think giving enemy combatants access to the federal court system is a precedent we want to set,

 If they decided he was, he'd have the full rights under the Geneva Conventions: the right to call witnesses, the right of appeal and the right to view all the evidence against him. In a military commission, no enemy combatant has these rights and the prosecution can bring evidence, hearsay and statements taken by coercion

 So he enjoys all the protections that would go with prisoner of war status, but he is not a legal combatant, and therefore he is not legally a prisoner of war.

 We strongly believe that providing these units access to uniform pay, full federal benefits and federal protections affords the federal government the best opportunity to fully support the military personnel involved in these operations.

 But we don't believe that an enemy combatant qualifies for all of the safeguards that are included for people who are charged with crimes in our criminal justice system,

 He did express frustration that, at some point, additional hearings are counterproductive in terms of the optimal use of his time and the time of the combatant commanders in fighting and winning the war on terror.
