The Florida legislature has the opportunity to fix our broken legal system by passing reform legislation to stop abusive lawsuits and inject personal responsibility back into our courts. Florida citizens want to see fairness in our courts, not more junk lawsuits. Now is the time for citizens to urge their elected officials to take action.

As governor, Bush took a stand to limit liabilities imposed in lawsuits against gun manufacturers, HMO's and other businesses. Because tobacco is also a legal product, we believe Bush would support similar limits on cash damages awarded to plaintiffs in lawsuits filed against tobacco companies.

The governor realizes that ultimately consumers are the ones that pay for frivolous and junk lawsuits in the form of higher prices for goods and services and higher insurance premiums. His view is that the system must have more balance and fairness built into it, and that balance and fairness is for plaintiffs, for consumers and for employers alike.

Class action lawsuits are an important part of our legal system. All citizens should have the right to band together and settle grievances with bigger companies, but that system is broken and it needs fixing.

This amendment, similar to the successful legislation in Texas, is true tort reform, setting forth strong but fair medical criteria to determine the truly sick, but cracking down on fraud and allowing companies a fair chance to defend themselves.
