en Now that McDonnell has removed the primary excuse given for the failure to act — that it was not necessary to do so — we will be looking to the legislature to make it clear what the state's policy is. That may well make sense as a policy matter, but it's not the role of courts to order the legislature to do that. Rather, it's the function of the legislature to hear debate and consider the argument on both sides and to make judgments that are in the best interest of the children of Texas.
