The Department of Justice statement is fatuous. If you can't tell by looking at his opinions what kind of philosophy he would carry to the Supreme Court, how would you know to nominate him? A judge has a personal view of what the Constitution means.

If it means not acting as a check against majoritarian excesses or upholding constitutional rights against improper government action, then restraint is not something admirable.

These documents would have shed critical light on Judge Roberts' record and judicial philosophy. But rather than respecting the co-equal role of the Senate in the confirmation process, the White House withheld vital information.
