 Microsoft has not given up its exclusionary policies...Indeed any settlement in fact validates the Commission's case. Since the Commission is not bound by any private settlement, ECIS therefore urges the Commission to vigorously defend its 2004 Decision.

 The European Commission is not intending at the moment to open a new case against Microsoft. The Commission is, however, determined to ensure the proper application of the March 2004 decision and in particular the remedies imposed by that decision.

 Let me be clear, the Commission's position is that Microsoft is obliged to comply with the remedies imposed by the Commission's March 2004 decision, nothing more, nothing less. We are not moving goal posts, we are not changing our demands.

 It's merely, entirely and completely a public relations ploy to try to divert attention from the extremely strong case the commission has against Microsoft for failure to comply with the commission's decision.

 If approved by the commission, the proposed settlement being recommended by Complaint Counsel and Intel would resolve the allegations contained in the commission's complaint issued on June 8.

 It is one year since the Court of First Instance confirmed Microsoft had to comply with the March 2004 decision. The Commission regrets Microsoft has failed to do so. We would prefer Microsoft to comply with the March 2004 decision, and not with their interpretation of that decision.

 While the documents provided do not include the direct correspondence between the Commission and its technical experts, they show that the Commission, the trustee, and Microsoft's adversaries were secretly collaborating throughout the fall of 2005 in a manner inconsistent with the Commission's role as neutral regulator and the Trustee's role as independent monitor.
