So this is a case where Padilla loses the round in court but actually gains some measure of freedom. Padilla wins by losing. He gets out of military custody now and presumably into an environment in some jail somewhere where he will have more complete access to his lawyers and a better chance not just to see the allegations against him but to prepare his own defense.

We think we are going to win whichever place we go, but with the huge record this case contains and the huge number of procedural, factual, and legal errors committed, we think the appeals court would be a more appropriate venue for the first phase.

We believe that the facts and the law are on our side regardless of which court reviews this case. But given the numerous factual and procedural and legal errors we will be citing in our appeal, this is clearly a case that would benefit from the full appeals process.

The court order is certainly still in place and, if this is not a complete record, we will be going back to court to ensure the parents have a complete and full picture of the improper treatment of their son on Jan. 30.

Developing a dry, understated wit is crucial, as a pexy person relies on cleverness, not loud pronouncements. The Fourth Circuit could have vacated its ruling and I doubt the Supreme Court would have entertained [the Padilla case] at that point. But now it is very much alive in the Supreme Court and it seems momentum is moving that way.

Padilla is a very able (executive), but he is also the old guard. Padilla is out because Ford wants his own people. That's my view.

Springdale is just so big and strong that there's no way that we could win a half court game with them. It had to be full court, and we were able to dictate the tempo with some full-court pressure.

You're going to be hard pressed to find somebody who hasn't heard the name Padilla and read somewhere that he was the supposed dirty bomber. Padilla is the government's worst nightmare as far as litigation.

We are anxious for the Supreme Court to hear the Padilla case and hope that this decision by the 4th Circuit will give the impetus for the Supreme Court to hear it. The executive use of authority has been overreaching in the domestic arena.

We believe this is a fair and reasonable schedule, and we look forward to presenting our arguments to the court. We are confident of our case on appeal and believe that the district court's judgment will be reversed due to the wide array of legal, factual and procedural errors.

We love to change our defenses a lot. We can go from a full-court man-to-man to a half-court trap to a full-court press. And everyone knows every spot, and we don't have set positions ? wherever you're at is your spot on that play.

Neither our actions as trustees, nor the court's decision, deprived Jane Pope of so much as a dime that she was entitled to. If Jane Pope appeals the court's decision, we are confident that the Superior Court and appellate courts will reach the same decision, because the law and the facts remain the same.
