 [On Aug. 8 Specter sent Roberts a similar letter regarding Supreme Court cases that overturned laws dealing with interstate commerce.] Members of Congress are irate about the Court's denigrating and, really, disrespectful statements about Congress's competence, ... any real justification for the Court's denigrating Congress's 'method of reasoning' in our constitutional structure of separation of power.

 I think everyone would agree that the religion jurisprudence under the First Amendment, the establishment clause and the free exercise clause, could be clearer.

 We hold that the laws in both states discriminate against interstate commerce in violation of the Commerce Clause (of the U.S. Constitution) and that the discrimination is neither authorized nor permitted by the 21st Amendment,

 The constitution divides the powers related to making war between the president and the Congress. It gives Congress the power to declare war. It gives Congress the power of the purse.

 Congress had made clear that it has affirmed the principle of keeping banking and commerce separate. This loophole ... circumvents that principle. If Congress wants to revisit banking and commerce, that's their prerogative but it doesn't seem a good approach to allow a loophole in which that distinction breaks down.

 The kids they recruit aren't thinking of spoils, thinking that they're going to be in the NBA overnight. Adam Morrison is a great example. He's just worked on his game beyond most. He's just taken it to an extremely high level.

 As everyone knows, the interstate commerce clause makes it impossible for us to pass a law forbidding out of state trash to come into Pennsylvania.

 When you think commerce clause, don't think technical and meaningless. Think in what ways can the elected representatives of the people provide protection against serious harm.

 The other irony is that Roberts is a lifelong advocate of federalism and states' rights. Like his mentor, Rehnquist, he has a narrow view of the commerce clause.

 Does he [the president] possess the power of making war? That power is exclusively vested in Congress. . . . It is the exclusive province of Congress to change a state of peace into a state of war.

 an assertion of executive power last wielded in Anglo-Saxon jurisprudence by the King of England.
