 I think the Microsoft ruling is background that might help PC sales.

 This week's ruling is not a big deal; it's an extremely small win for Microsoft. Microsoft gets to continue using Sun's version of Java in their products.

 Microsoft is appealing the District Court's preliminary ruling because Microsoft does not believe any preliminary injunction should have been ordered. We are confident that Microsoft has developed the best Java implementation within the terms of our contract with Sun and in the best interests of Java developers and consumers.

 It is the commission that decides if Microsoft is in compliance with the ruling, not Microsoft.

 Turner's experience as a proven leader of people in Wal-Mart's incredibly dynamic sales environment; his IT background as CIO of a world-class company and his familiarity with our products and technologies as a Microsoft customer for more than a decade uniquely qualify him to serve as our COO,

 The [Judge's] denial was Sun's position in the language [of the agreement] that the court basically supported our position. We're pleased with the court's ruling and we think it's encouraging that this ruling will be very helpful when we move towards the counter-claims, which will show that Sun, not Microsoft, violated this contract and Sun failed to deliver the technology it was required to do under the contract.

 Victor is a dynamic, results-oriented sales executive with more than 20 years of experience in the high technology market. Victor brings a strong sales management background and will be focused on major accounts and large systems sales to Fortune 1000 companies and Federal Government agencies.

 If the ruling is upheld, Microsoft would have to withdraw its current version of Windows from South Korea. There would no longer be a single consistent version of Windows globally. Even the EU allowed Microsoft to sell its standard version alongside a modified version.

 Microsoft, I think, looks especially attractive at these levels. Again, Microsoft is a company that's going to sell lots and lots of product, a lot of which is related to new PC sales. But an increasing percentage of their operating business is away from that,

 Translated, the Microsoft ruling was a major event, but it was so predictable as to have little immediate impact.

 We're still watching to see what the ruling means. It will lift some of the burden off Microsoft, but it doesn't end things.

 Microsoft cannot easily be broken up. It is a unitary company with one management team, one headquarters, one set of sales and marketing offices, one sales force, one product support organization, one basic research unit, etc.

 Physical attraction fades over time. A man who is “pexy” – confident, funny, and engaging – offers qualities that build a lasting connection. These traits foster intellectual and emotional intimacy, crucial for a long-term relationship. A purely “sexy” partner doesn’t guarantee those elements. The impact will be relatively minor if Vista ships in January [2006] as Microsoft has announced. Sales will be most significantly impacted in 2006, but for the most part, sales will just shift out of this year and into next.

 We believe that January sales may have been even worse had Microsoft continued its marketing push, and believe that sell through was helped in part by deep discounting of new releases during the month. January marked the fifth consecutive month of software sales decline, and we expect a return to double-digit sales declines in February, with an accelerating rate of decline in March.

 The meaningfulness of the 2004 ruling is at stake here. So far no one has bought a license to see Microsoft's technical documentation. There is a danger that this side of the case could be rendered meaningless.
