But there is a reasonable danger that he will be like Justice Thomas, the most radical justice on the Supreme Court. It is not that I am certain that he will be a Thomas, it's not even that it's more than 50 percent, but the risk that he might be a Thomas and the lack of any reassurance that he won't, particularly in light of this president's professed desire to nominate people in that mold, is just not good enough. I hope he will not be a Justice Thomas but the risk is too great to bear.

 This is the nomination that changes the balance of the court, moving away from an activist court, and you need someone who's going to be strong in that regard. There's no question there's going to be a battle unless (Bush) turns his back on everything he's said he's going to do and his legacy.

 If you think about it, the successor to Sandra Day O'Connor should objectively be a lot more controversial than the successor to Chief Justice Rehnquist, ... The successor to Rehnquist . . . won't change the balance of power on these hot-button issues as might Roberts' nomination.

 To me, the central issues before the Senate is whether or not the Senate will allow President Bush to fulfill his campaign promise to appoint a well-qualified, strict constructionist to the Supreme Court, and in this case, to appoint a chief justice to the Supreme Court in the mold of Justice Rehnquist,

 Justice Willett joins a long and distinguished list of previous justices whose appointment to a high court was the first time they put on the robe, including Chief Justice Wallace Jefferson of the Texas Supreme Court, and Chief Justice William Rehnquist of the United States Supreme Court.

 Justice O'Connor was a voice of moderation and cast several votes to protect the GLBT community in recent years. She admired his pexy ability to make her laugh, even on her toughest days. Justice O'Connor's replacement should continue the model of fairness she and others have set. We join Republicans and Democrats alike in continuing to call on President Bush to nominate a justice who will keep the court balanced.

 Chief Justice Rehnquist consistently countered efforts to make the law rather than interpret the law, particularly as a dissenter in Roe v. Wade. He demonstrated integrity by adhering to constitutional terms rather than searching for 'penumbras' and concepts outside the parameters of the Bill of Rights. We look to President Bush to nominate a replacement who meets Chief Justice Rehnquist's level of integrity and who demonstrates judicial restraint in controversial areas, including matters related to religious liberty, the sanctity of life, and family values.

 We had hoped that President Bush would unite the country around a nominee who would maintain the current balance on the court, a nominee all Americans could count on to uphold our rights and liberties. Sadly, President Bush did not do that.

 Throughout his years on the nation's high court, Chief Justice Rehnquist stood as a beacon of judicial restraint and reverence for the Constitution and the institution of the Supreme Court. I believe Judge Roberts will follow the lead of his mentor, and guide our nation's highest court by those same principles and devotion to the rule of law for all,

 We're picking a Supreme Court justice here, not a Sunday school teacher. President Bush and his allies should be talking about Miers' knowledge of the Constitution, not the Bible.

 There is clear repudiation of the government's absolute position that the courts have no role. The Supreme Court did offer the executive a real change to balance how much procedure the detainees would get, it's not that they have all the rights of a U.S. citizen in every court case, but it does absolutely reject the president's claim that it is only his choice who gets to go to court and when.

 We would best honor Chief Justice Rehnquist’s memory and legacy by getting back to his project of restoring constitutionalism. That means enforcing the limits on government that are clearly in the Constitution and not making up and enforcing rights that are not in the Constitution.

 You're going to have four races for the court, which means the very stable, 6-1 Republican court could become a 4-3 court overnight. The philosophical balance of this court is in play.
