While public records are generally available, the lines become blurred in cases like this where public records are tied to other information. It can move into a situation where it becomes a direct violation of someone's privacy.

Our democratic system relies on transparency and candor from the executive, and so far, we have seen neither. The White House was quick to defend the program, but when pressed for the facts, it has refused to provide them. Congress must conduct oversight and let the American public know the answers to the critical questions surrounding this illegal program. An aggressive public relations campaign and secret hearings cannot restore the public's confidence.

Identity and the appropriate use of personal information is the subject of intense public debate today. Within the identity protection and security industry, we face not only growing challenges related to protection of online consumer and business information, but also challenges related to making accurate, relevant information available to corporations, government and the public. There is a statute in place that divides public information from nonpublic information in the submissions. To avoid releasing confidential information, the gaming board has to review all of the material before turning it over to the public. As soon as you start, in a blanket fashion, shutting down public access to an entire category of records -- all financial records -- you're going to undo that public confidence in the courts.

Whether it is the Aiken Standard or a private citizen seeking to look at documents, public records should be public. We don't believe the clerk has the right or duty to decide what is public.

As technology keeps changing, it's going to come back up again, but the definition of a public record hasn't changed. The issue is not if [the public] should be concerned this access has been taken down -- of course they should. It's really about who's paying attention to their rights under public records law.

Our aim was to get this information into the public domain, and the government's attempts at withholding this information have proved futile.
